A by-law to amend "Surrey Zoning By-law, 1979, No. 5942."

THE MUNICIPAL COUNCIL of The Corporation of the District of Surrey, in open meeting assembled, ENACTS AS FOLLOWS:
l.     "Surrey Zoning By-law, 1979, No. 5942," as amended, is hereby further amended, pursuant to the provisions of Section 963 of the "Municipal Act," and the classification of the following parcels of land, presently shown upon the maps designated as the "Zoning Maps" and marked as Schedule "A" under PART III of the said By-law No. 5942, is hereby amended as follows:
          FROM "SUBURBAN RESIDENTIAL ZONE (RS)" TO
          "COMPREHENSIVE DEVELOPMENT ZONE (C-D)"
          Parcel "E" (Explanatory Plan 9477) South Half of the South East Quarter, Section 17, Township 8, New Westminster District.

(hereinafter referred to as "the land")
2.     The following regulations shall apply to the lands herein:
     A.     INTENT
This Comprehensive Development Zone is intended to accommodate and regulate the development of a self-serve gasoline service bar and a convenience store.
     B.     PERMITTED USES
The land and structures shall be used for the following uses only, or for a combination of such
uses, provided such combined uses are part of a comprehensive design:
          1.     Combined self-serve and full-serve gasoline stations.
          2.     The following uses which shall be clearly incidental to the sale of gasoline:
               (a)     The sale of automotive accessories
          3.     Grocery stores, not exceeding 253.4m2 (2727 square feet).
     C.     LAND DEVELOPMENT
          Notwithstanding any other provision of this zone, the uses permitted by Section B shall be conditional upon the immediate availability and adequacy of those Municipal facilities and services hereinafter set forth to serve each parcel of land and each unit of every building, structure to be erected or placed, and any use to be carried on thereon.  No use of land and no use of any building or structure thereon shall be deemed to be authorized by Section B of this By-law, and all uses otherwise permitted by this By-law are hereby prohibited unless and until all the following services and facilities have been provided and are immediately available and are adequate therefore to the standards set out as follows:
           (i)     Sanitary sewer, waterworks and drainage works to the standards set out for the C-G(1) Zone in "Surrey Subdivision By-law, 1986, No. 8830" and amendments thereto as applicable.
          (ii)     All highways abutting and serving the land including boulevards, street lighting, underground wiring, sidewalks and transit service facilities to the standards set out for the C-G(1) Zones in "Surrey Subdivision By-law, 1986, No. 8830" and amendments thereto as applicable.
          (iii)     Where the uses permitted for the site under the zone, as listed in Section A herein, have varying highway and/or servicing standards as set out in " Surrey Subdivision By-law, 1986, No. 8830", the standards requiring the greater capacity shall apply over the entire site.
     D.     DENSITY, SITE COVERAGE
          (i)     Density - The maximum density shall not exceed a floor area ratio of zero decimal fifteen (0.15).
          (ii)     Site coverage - The maximum lot coverage of building and structures, excluding canopies shall be fifteen percent (15%).
     E.     HEIGHT OF STRUCTURES
          1.     Principal buildings: The height of the principal building shall not exceed one (1) storey and a maximum of 22.5 feet.
          2.     Canopy:  The height of the canopy shall not exceed seven (7) metres [22.5 ft].
     F.     YARD AND SETBACKS
          1.     Principal buildings shall be situated as hereinafter set forth:
               (a)     East Property Line - The minimum setback shall be thirteen decimal seventy two (13.72) metres [45.02 ft.].
               (b)     West Property Line - The minimum setback shall be seven decimal five (7.5) metres [25 ft.].
               (c)     North Property Line  - The minimum setback shall be six (6.0) metres [19.68 ft.].
               (d)     South Property Line - The minimum setback shall be twenty decimal zero one (20.01) metres [65.6 ft.].
          2.     Accessory structures shall be situated as hereinafter set forth:
East Property Line
               (a)     The minimum front setback shall be twelve decimal nineteen (12.19) metres, [40 ft.].
               West Property Line
               (b)     The minimum setback shall be one twenty-one decimal twenty-nine (21.29) metres, (69.88 ft.).
               South Property Line
               (c)     The minimum setback shall be three decimal zero five (3.05) meters [10 ft.].
     G.     LANDSCAPING
          1.     Any building or structure being erected, enlarged or increased in capacity shall make provision for landscaping as hereinafter set forth:
               (a)     Landscaping shall cover not less than twenty-one point six (21.6) per cent of the developed site area.
               (b)     A continuous landscaping strip, not less than one decimal five (1.5) metres wide, shall be provided along the developed portion of each side of the site which abuts a public highway.  This landscaping strip need not have a net area exceeding ten (10) percent of the developed site area, and may be interrupted at boulevard crossings, or to provide necessary pedestrian access for entering a building or for viewing shop windows.
               (c)     Except in those portions where a building abuts the property line, screen planting at least one decimal five (1.5) metres high in a strip at least one decimal five (1.5) metres wide, or a solid decorative fence at least one decimal five (1.5) metres high shall be provided along all property lines separating the developed portion of the site from any residentially zoned property.
               (d)     Loading areas or trucking yards shall be screened from adjacent residentially zoned property to a height of at least two decimal five (2.5) metres by a landscaping screen, a solid decorative fence, or a combination thereof.
               (e)     The boulevard areas of highways abutting the site shall be seeded or sodded with grass on the side of the road abutting the site except at driveways.
     H.     OTHER REGULATIONS
          1.     In addition, land use regulations, including the following, are applicable:
               (a)     Prior to any use, lands must be serviced as set out in Part II of this By-law, in accordance with "Surrey Subdivision By-law No. 8830", as amended;
               (b)     General provisions on use are as set out in Part IV of "Surrey Zoning By-law, 1979, No. 5942", as amended;
               (c)     Additional off-street parking requirements are as set out in Part V of "Surrey Zoning By-law, 1979, No. 5942", as amended;
               (d)     Building construction shall be subject to the Surrey Development Cost Charge By-law, No. 10983, and amendments thereto based on the C-G(1) Zone;
               (e)     Sign regulations are as set out in Part VI of "Surrey Zoning By-law, 1979, No. 5942," as amended.
3.     This By-law shall be cited for all purposes as "Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1993, No. 11827".
READ A FIRST AND SECOND TIME on the 3rd day of May, 1993.
